We collect different data depending on how you interact with us.

If you’re a business client or prospective client:

• Contact details: name, work email, phone number, company name, job title
• Project details: what you tell us about the problem you want solved, target market, budget or timeline indications
• Billing information, where applicable, once tied to a signed engagement

If you’re a candidate:

• Contact and identity details: name, email, phone number
• Career information: resume/CV, degree level and field of study, work history, LinkedIn and portfolio links
• Placement-specific information: current visa or work-authorization status, target market, availability, and (where relevant to our H-1B Visa Guide) employer-sponsorship history you choose to share with us
• Interview and feedback records generated during the placement process
• Job application details, if you apply to a role listed on our Jobs page

From everyone:

• Anything you send us by email, form, or phone
• Automatically collected data: IP address, browser and device type, pages visited, and similar usage data, collected through cookies and similar technologies (see “Cookies and Analytics” below)

• Respond to inquiries and schedule scoping calls or intake sessions
• Deliver the service you’ve engaged us for: software development for business clients, or profile building, employer matching, interview preparation, and placement support for candidates
• Match and refer candidate profiles to prospective employers in our hiring network, which is the core purpose of our placement service
• If you apply to a role on our Jobs page, including a vendor-sourced role, evaluate your application and, if you aren’t selected for that specific role, consider you for other open roles or UpWia placement services
• Communicate with you about your engagement, including service-related updates
• Send marketing communications where you’ve agreed to receive them, which you can opt out of at any time
• Improve our website and services
• Meet legal, tax, and regulatory obligations

Where applicable data protection law, including the EU General Data Protection Regulation, requires a legal basis, we rely on your consent, the necessity of processing to perform a contract with you (such as a placement or development engagement), our legitimate interests in operating and improving our business, and compliance with legal obligations. You may withdraw consent at any time where consent is the basis for processing, without affecting processing already carried out.

We do not sell your personal data. We share it only as follows:

• Candidate profiles are shared with prospective employers and hiring partners in our network, since referring your profile is the core service we provide. We share only what’s needed to support a placement.
• Service providers who help us operate our website and deliver our services, such as hosting, email delivery, scheduling, and analytics providers, under confidentiality obligations.
• Legal and safety reasons: complying with a legal obligation, enforcing our Terms of Service, or protecting the rights, property, or safety of UpWia, our clients, candidates, or others.
• Business transfers: if UpWia is involved in a merger, acquisition, or sale of assets, personal data may transfer as part of that transaction. We’ll provide notice before your data becomes subject to a different privacy policy.

We use cookies and similar technologies for two purposes: keeping the website working correctly, and understanding how visitors use our site through analytics. Most browsers let you refuse or delete cookies through their settings, though doing so may affect how well parts of the site work. Where required by law, we’ll ask for your consent before setting non-essential cookies.

Because we operate across the United States, Canada, the European Union, and Australia, your data may be transferred to and processed in a country other than the one you’re in. Where we transfer personal data out of the EU or another region with data transfer restrictions, we put appropriate safeguards in place, such as standard contractual clauses, to protect it.

We retain personal data only as long as needed for the purpose it was collected, including to provide our services, meet legal or tax obligations, resolve disputes, and enforce our agreements. When data is no longer needed, we delete it or anonymize it.

• European Economic Area: these rights arise under the GDPR, and you also have the right to lodge a complaint with your local data protection authority.
• United Kingdom and Switzerland: an equivalent regime applies.
• California: you have rights under the CCPA/CPRA, including the right to know, delete, and opt out of the sale or sharing of personal data. We do not sell personal data.
• Canada: PIPEDA and applicable provincial law give you similar access and correction rights.
• Australia: the Privacy Act 1988 and the Australian Privacy Principles apply.

Our website and services are not directed at children, and we do not knowingly collect personal data from anyone under 18. If you believe a minor has provided us personal data, contact us and we’ll delete it.

Our website may link to third-party sites we don’t control, including employer websites during the placement process. Their privacy practices are governed by their own policies, not this one.

We may update this Policy from time to time. If we make material changes, we’ll post the updated version here with a new “Last updated” date.
